1. DESCRIPTION OF THE CONTEST:

The GlassFish Awards Program (the "Contest") is designed to encourage and recognize innovation and community participation with GlassFish Community related activities and contributions. An Entry may consist of either: (1) a report to address known bugs in a GlassFish project (a "Bug Report Entry"); or (2) an original contribution to or benefit of an existing or new GlassFish project (a "Contribution Entry"). Prize winners will be selected by a panel of judges based on the criteria set forth in these Official Rules.

2. ELIGIBILITY:

This Contest is open only to individuals who lawfully reside in the following countries and who have reached the legal age of majority: Argentina, Australia, Austria, Belgium, Brazil, Bulgaria, Cambodia, Canada, Chile, China, Croatia, Czech Republic, Denmark, Finland, France, Germany, Hungary, India, Indonesia, Ireland, Israel, Italy, Japan, Korea, Malaysia, Mexico, New Zealand, Norway, Peru, Poland, Romania, Russia, Singapore, South Africa, Spain, Sri Lanka, Sweden, Switzerland, Taiwan, Thailand, the Netherlands, the Philippines, the United Kingdom, Turkey, Venezuela, and the fifty United States and the District of Columbia. Individuals or teams of up to three (3) individuals are eligible. Companies are not eligible to enter. Employees of Sponsor and Sun Microsystems, Inc. ("Sun"), and each of their respective parent companies, affiliates and subsidiaries, participating advertising and promotion agencies (and members of their immediate family, defined as parents, children, siblings and spouse, regardless of where they reside, and/or those living in the same household) are not eligible. You must also have access to the Internet and a valid email address in order to enter. Entries may be submitted by a single individual or by a team of up to three (3) individuals. There is no limit on number of entries per person or team. However, one individual may not be awarded more than five (5) prizes in the Bug Report category or more than one (1) prize in the Contribution category. If an Entry is submitted by a team, each individual member of the team must meet the eligibility requirements set forth herein. The term "Entrant" as used in these Official Rules refers to each eligible individual and/or team that submits an entry.

IMPORTANT NOTICE TO ENTRANTS: ALL DEADLINES SET FORTH IN THESE OFFICIAL RULES ARE STATED IN UNITED STATES PACIFIC STANDARD TIME. ENTRANTS ARE RESPONSIBLE FOR DETERMINING THE CORRESPONDING TIME ZONE IN THEIR RESPECTIVE JURISDICTIONS.

3. HOW TO ENTER:

To enter, you must be a member of the GlassFish Community. If you are not a member of the GlassFish Community, go to http://www.java.net/servlets/Join to register. If your Entry contains a contribution to or is a derivation of a GlassFish Community Project, it must be contributed to the GlassFish project under the terms of the Sun Contributor Agreement (see http://www.sun.com/software/opensource/sca.pdf). Legal requirements of specific GlassFish projects are available at https://glassfish.java.net/public/GovernancePolicy.html. All Entries must be submitted in accordance with an applicable OSI approved license, available at http://www.opensource.org/licenses.

For team Entries, each individual member of the team must be a member of the GlassFish Community and (if applicable) must have signed the Sun Contributor Agreement at the time the Entry is submitted. Failure to do so will result in the disqualification the team's Entry. Also, the team must designate one individual member of the team as the Team Leader for contact purposes only. The team leader shall be responsible for submitting the Entry on behalf of the team and shall designate all members of the team with the Entry submission.

To enter, you must develop and submit either a Bug Report Entry or a Contribution Entry (each referred to as the "Entry") that meets the goals set forth below and complies with the Submission Guidelines and other requirements of these Official Rules. The Bug Report Entry and Contribution Entry is described below:

A. Bug Report Entry: Submit a report that addresses known bugs in a GlassFish project. Entry must comply with the bug tracking system guidelines for the GlassFish project, available at http://glassfish.org/issues. To report bugs, you will be required to log in to the glassfish.org infrastructure.

B. Contribution Entry: Submit an original contribution which helps to enhance or develop the GlassFish Community. Examples of contributions are as follows: Develop a software application that enhances or augments the value of GlassFish developments; (ii) Create blueprints or documentation on specific GlassFish topics, such as clustering, horizontal scaling techniques, architecture tuning, scripting); (iii) Develop curricula or tools courseware that are localized and technology focused; (iv) Implement a compatible, free software alternative to a remaining bit of encumbered code; (v) Set up user-groups; (vi) Create localized portals; (vii) Establish university presence; or (viii) Conduct GlassFish research, such as leveraging Solaris DTrace with GlassFish to improve troubleshooting.

In addition, the Entry must meet each of the following requirements:

A. The Entry must be written in plain text and in English. Although the Entry must be written in English, the implementation of the Entry need not be in English. For example, an Entrant may submit a Entry written in English demonstrating the localization of a GlassFish portal in Mandarin.

B. The Entry must be an original idea that can be employed in the GlassFish Community with the potential to leverage and extend the code base or Community infrastructure and features.

C. The Entry must be carried out in accordance with any and all legal requirements of the specific GlassFish project that is the subject of the Entry. For example, if an Entry proposes to add a new module to the GlassFish Application Server, it must be contributed to the GlassFish project under the terms of the Sun Contributor Agreement (see http://www.sun.com/software/opensource/sca.pdf). Legal requirements of specific GlassFish projects are available at https://glassfish.java.net/public/GovernancePolicy.html.

D. The Entry must not exceed a maximum of 1000 words.

E. To submit your Entry, e-mail your Entry to gap-submissions@glassfish.java.net. All Entries must be received between January 29, 2008 at 12:00 A.M. (PST) and June 30, 2008 at 11:59 P.M. (PST). The Sponsor's clock is the official time clock of the Contest. Proof of submission does not constitute proof of receipt.

F. The Entry must also include the individual and each team member's full name, email address, physical address, and country of residence.

4. SUBMISSION GUIDELINES:

In addition to the requirements set forth above, each Entry must comply with the following Submission Guidelines:

A. The Entry may not contain any content or material that is lewd, obscene, sexually explicit, pornographic, disparaging, defamatory, libelous, obscene, or otherwise inappropriate or objectionable, as determined by the Judges and/or Sponsor in their sole and absolute discretion.

B. The Entry must be the Entrant's original work, created solely by the Entrant, and must not infringe the copyright, trademark, privacy, publicity, or other intellectual rights of any person or entity.

C. All Entries, including without limitation, code, documentation and any elements of Entry must be available under at least one OSI approved open source license, available at http://www.opensource.org/licenses.

D. The Entry must not contain any personally identifiable information of any person other than the Entrant. Should the Entrant include personally identifiable information about him/herself in his/her Entry, Entrant acknowledges and agrees that such information will be disclosed publicly and Entrant is solely responsible for any consequences thereof.

E. The Entry must not contain any commercial content or logos of any entity other than Sponsor and Sun Microsystems, Inc. which may be incorporated only under the terms of any applicable licenses.

The Judges and/or Sponsor reserve the right to disqualify at any time, any Entry that they determine, in their sole and absolute discretion does not meet the requirements of the Official Rules, the Sun Contributor Agreement (if applicable), the applicable OSI license or these Submission Guidelines.

5. JUDGING/WINNER SELECTION:

A. Bug Report Entries will be judged by a panel based on the following equally weighted judging criteria:

  1. Impact of fix
  2. Difficulty of fix
  3. Completeness of fix
  4. Clarity of test case for bug report
  5. Description of bug fix
  6. Usefulness of fix

B. Contribution Entries will be judged by a panel based on the following equally weighted judging criteria:

  1. Originality
  2. Quality
  3. Usefulness to the GlassFish Community
  4. Completeness
  5. Impact of the Entry on the goals of the GlassFish Community, including: Enabling component reuse; (ii) Making the Java EE 5 Reference Implementation widely available; and (iii) Increasing the ease by which developers can participate in the GlassFish Community.

In the event of a tie, the person among the tied Entries with the highest score in Usefulness will be declared the winner. If ties still remain the tied entries will be re-judged on the same criteria. The Judges/Sponsor reserve the right to terminate the Contest and not to award any Prizes, if in their sole and absolute discretion they do not receive a sufficient number of eligible or qualified entries for the Contest. In the event that more than one Entry is received with the same or nearly identical idea, only the first such Entry received will be eligible, based on the date of the first draft submission of the Entry to the Contest entry mailing list. Winners will be notified by email, telephone or postal mail, within Sponsor's discretion. Decisions of Judges are final and binding.

6. PRIZES:

A total prize package of $175,000 will be awarded. $170,000 of this prize package will be divided among all Winners in accordance with the chart set forth above. $50,000 will be divided evenly among the winning Bug Report Projects. The exact amount of each Bug Report winning prize will depend on the total number of winning Projects. For example, if three Bug Report Projects win a prize, each Bug Report winner will be allocated one-third of the total Bug Report Prize package of $50,000. $120,000 will be awarded to the Contribution Projects. Of the winning Contribution Projects, the Grand Prize winner will receive $20,000; the Second Prize Winner will receive $10,000; the Third Prize Winner will $10,000 and each Base Winner will each receive $4,000. If an inadequate number of qualified winning Bug Report Entries are received, Sponsor reserves the right to not award the prize to any Bug Report Entry. If an inadequate number of qualified winning Contribution Entries are received to award the Grand, Second, Third and/or Base prizes, Sponsor reserves the right to (a) not award the prize to any Contribution Entry; (b)award fewer than the number of prizes stated above; or (c) award all of the prize money allocated to the Contribution Projects equally among the number of selected Contribution winners.

The Judges will also award Honorable Mention prizes to Entries from among both the Bug Report Entries and the Contribution Entries based on the judging criteria set forth above. $5,000 will be divided evenly among the winning Honorable Mention Awards. The number of Honorable Mention awards is within the sole discretion of the Judges. Sponsor reserves the right not to award any Honorable Mention awards if, in its sole and absolute discretion an inadequate number of qualified winning entries are received.

One individual may not be awarded more than five (5) prizes in the Bug Report category or more than one (1) prize in the Contribution category. An Honorable Mention award is considered to be part of both the Bug Report category and the Contribution category.

All other expenses not specified herein are the responsibility of the winners. All costs associated with currency exchange are the sole responsibility of the winners. ALL TAXES ARE THE SOLE RESPONSIBILITY OF THE WINNERS. In the event that a winning Entry was submitted by a team, the Prize will be divided equally among all team members who were named on the Entry submission.

Projects completed as a part of the Contest will be treated the same as any other contributions to the GlassFish Project, and subject to the governance processes that control acceptance and integration of contributions, available at https://glassfish.java.net/public/GovernancePolicy.html.

7. CONDITIONS OF PARTICIPATION.

Submission of Entry into this Contest constitutes Entrant's agreement to be bound by the terms of these Official Rules and by the decisions of the Judges and/or Sponsor, which are final and binding on all matters pertaining to this Contest. Return of any winner notification may result in disqualification and selection of an alternate winner. Any potential winner who cannot be contacted within 15 days of first attempted notification will be disqualified and forfeit any prize to which he/she may be entitled. Potential prize winner may be required to sign and return an Affidavit of Eligibility/Liability & where legally permissible, a Publicity Release within 30 days following the date of first attempted notification. Failure to comply within this time period may result in disqualification and selection of an alternate winner. If Entry is submitted by a team, the team leader shall be responsible for obtaining all team members' signatures on such affidavit and releases. If Entrant is a team, and any single team member fails to execute and return the required documentation within this time period, the team's Entry will be disqualified. Entrants who submit a contribution to or a derivation of a GlassFish Community Project acknowledge and agree that the intellectual and industrial property rights to the Entry, if any, are subject to the "contribution" provisions of the Sun Contributor Agreement. The intellectual and industrial property rights to the Contest submission, if any, will remain with the Entrants, except that these terms do not supersede any other assignment or grant of rights specifically required in these rules, such as the SCA, or required by any other separate agreements between Entrants and other parties. As a condition of entry, Entrants agree that Sponsor,Sun, and their agents shall have the right to use, copy, modify and make available the entry in connection with the operation, conduct, administration, and advertising and promotion of the Contest via communication to the public, including, but not limited to the right to make screenshots, animations and video clips available to the public for promotional and publicity purposes. Acceptance of the Bug Report, Contribution or Honorable Mention prize constitutes permission for, and winner's consent to Sponsor, Sun and its agencies to use the winner's name, likeness and/or Entry, in whole or in part for advertising and promotional purposes including without limitation posting Entries on the GlassFish Community wiki, without additional compensation, unless prohibited by law. To the extent permitted by law, entrants agree to hold Sponsor, Sun and each of its parent, subsidiaries, agents, directors, officers, employees, representatives, and assigns harmless from any injury or damage caused or claimed to be caused by participation in the Contest and/or use or acceptance of any prize won, except to the extent that any death or personal injury is caused by the negligence of the Sponsor. Sponsor and Sun are not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prize. An Entrant may be prohibited from participating in this Contest if, in the Sponsor's sole discretion, it reasonably believes that the Entrant has attempted to undermine the legitimate operation of this Contest by cheating, deception, or other unfair playing practices or annoys, abuses, threatens or harasses any other Entrants, the Sponsor or associated agencies. If Entrant is a team, and Sponsor determines in its sole discretion that any single team member has attempted to undermine the legitimate operation of this Contest, all members of such team may be disqualified, as determined within Sponsor's sole discretion. Due to the unique nature and scope of this Contest, Sponsor reserves the right to alter or modify these Official Rules at any time.

8. NO RECOURSE TO JUDICIAL OR OTHER PROCEDURES:

To the extent permitted by law, the rights to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded, and any Entrant expressly waives any and all such rights. In the event that a court of competent jurisdiction finds the foregoing waiver unenforceable, Entrants hereby consent to the jurisdiction and venue residing exclusively within the federal or state courts in the state of California, United States and agree that any and all disputes, claims, and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action. Entrants agree that these Official Rules are governed by the laws of California.

9. DATA PRIVACY:

Entrants agree that personal data, especially name and address, may be processed, stored and otherwise used for the purposes and within the context of the Contest and any other purposes outlined in these Official Rules. The data may also be used by the Sponsor in order to check Entrants' identity, their postal address and telephone number, or to otherwise verify their eligibility to participate in the Contest. Entrants have a right to access, review, rectify or cancel any personal data held by the Sponsor by writing to Sponsor (Attention: privacy@sun.com). If Entrant's data is not provided or is canceled, Entrant's Entry will be ineligible. By participating in the Contest, Entrants hereby agree to all personal information uses and disclaimers as explained in Sponsor's Privacy Policy. Participation in the Contest further constitutes Entrant's full and unconditional agreement to and acceptance of these Official Rules and Sponsor's Privacy Policy and willingness to be contacted by telephone and/or email. If Entrant is a French resident, by entering the Contest such Entrant gives consent to the transfer of the personal data outside the European Union in connection with the above purposes, and that such data will be transferred to the United States.

10. WARRANTY AND INDEMNITY:

Entrants certify that their Entry is original and that they have the right to submit the Entry in the Contest. Each Entrant agrees not to submit any Entry that (1) infringes any 3rd party proprietary, intellectual property, industrial property, personal rights or other rights, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligation; (2) includes any personally identifiable information or (3) otherwise violates applicable law in any countries in the world. Entrants certify that their Entry complies with the Sun Contributor Agreement (if applicable). To the maximum extent permitted by law, each Entrant indemnifies and agrees to keep indemnified the Sponsor and Sun at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the Entrant and/or a breach of any warranty set forth herein. To the maximum extent permitted by law, each Entrant indemnifies and agrees to keep indemnified the Sponsor and Sun at all times from and against any liability, actions, claims, demands, losses, damages, costs and expenses for or in respect of which the Sponsor or Sun will or may become liable by reason of or related or incidental to any act, default or omission by an Entrant under these Official Rules including without limitation resulting from or in relation to any breach, non-observance, act or omission whether negligent or otherwise, pursuant to these official rules by an Entrant.

11. ELIMINATION:

Any false information provided within the context of the Contest by any Entrant concerning identity, postal address, telephone number, ownership of right or noncompliance with these rules or the like may result in the immediate elimination of the Entrant from the Contest. If Entrant is a team, and any single team member provides such false information, Sponsor reserves the right to disqualify the entire team. Sponsor further reserves the right at any time, including after announcement of Winners to disqualify any Entry that it believes in its sole and unfettered discretion infringes upon or violates the rights of any third party or otherwise does not comply with these Official Rules.

12. INTERNET:

Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission. Sponsor is not responsible for theft or destruction or unauthorized access to or alterations of Entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind. Sponsor is not responsible for inaccurate transmissions of or failure to receive Entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof, except to the extent that any death or personal injury is caused by the negligence of the Sponsor. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, disruption or termination of the Contest site for any reason or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest. Sponsor reserves the right at its sole discretion to immediately cancel, terminate, modify or suspend the Contest. Sponsor reserves the right to select winners from eligible entries received as of the termination date. Sponsor further reserves the right to disqualify any individual who tampers with the entry process. Caution: Any attempt by an Entrant to deliberately damage any Web site or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such Entrant to the fullest extent of the law.

13. SEVERABILITY:

If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

14. WINNER'S LIST:

For Winner's name, log onto http://glassfish.org/GAP on or about August 15, 2008, available for a period of up to 60 days.

15. SPONSOR:

The Sponsor of this Contest is the GlassFish Community, at http://glassfish.org. Sun Microsystems, Inc., is funding all of the prize awards, however, Sun Microsystems shall have no liability or responsibility in connection with the Contest other than to fund the prize awards specified herein.
